1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and MedTalk Central, operated by ANIDM under the ownership of Amandeep Singh Vaseer, governing your access to and use of medtalkcentral.com and all associated services (the "Platform").

By accessing or using the Platform — including submitting a query, uploading a file, or registering an account — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Nature of the Platform — Critical Disclaimer

MedTalk Central is an AI-powered health information platform. You must clearly understand the following:

• All information provided by the AI is for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY.
• No information constitutes medical advice, diagnosis, treatment, prescription, or clinical recommendation.
• No doctor-patient relationship is created between you and MedTalk Central or its AI system.
• AI responses are generated by an automated language model (Claude by Anthropic) and may contain errors or outdated information.
• We do NOT verify the accuracy of AI-generated content for your specific medical condition.
• ALWAYS consult a qualified, licensed healthcare professional before making any health decision.
• For medical emergencies, call 108 (ambulance) or 112 (emergency) immediately.

3. Eligibility and Account Registration

3.1 User Eligibility

• You must be at least 13 years of age to use the Platform.
• Users between 13 and 18 must have parental or guardian consent.

3.2 Account Registration

• You agree to provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at [email protected] if you suspect unauthorised access.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Healthcare Provider Accounts

4.1 Provider Registration

• By registering as a provider, you confirm all information (qualifications, registration numbers, specialties) is accurate and current.
• False or misleading professional claims may result in immediate account termination and may be reported to regulatory bodies.

4.2 Provider Subscriptions

• Plans: AI Visible (₹499/month), AI Priority (₹1,499/month), AI Authority (₹4,999/month).
• Payments processed by Razorpay. By subscribing, you agree to Razorpay's terms of service.
• Subscriptions are non-refundable once activated, except where required by law.
• We reserve the right to modify plans and pricing with 30 days' notice.

4.3 Provider Conduct

• Providers must not make misleading claims about qualifications or success rates.
• MedTalk Central does not guarantee patient leads or bookings — we are a discovery platform only.
• Providers must comply with all applicable laws including the Indian Medical Council Act and Consumer Protection Act 2019.

5. Permitted and Prohibited Use

5.1 Permitted Use

• Searching for health information through the AI assistant.
• Uploading your own medical reports for AI-assisted interpretation (educational only).
• Browsing and contacting healthcare providers listed on the Platform.
• Registering and maintaining a user or provider account.

5.2 Prohibited Use

You MUST NOT use the Platform to:

• Provide false personal or professional information.
• Upload obscene, defamatory, or illegal content.
• Scrape, crawl, or extract data without authorisation.
• Reverse-engineer or copy any part of the Platform's technology.
• Impersonate any person, healthcare professional, or organisation.
• Upload malware, viruses, or malicious code.
• Harass, abuse, or threaten other users or providers.
• Attempt to manipulate AI responses or circumvent Platform safeguards.
• Commercially exploit AI-generated responses without written permission.

6. AI-Generated Content — Limitations

1. AI responses are probabilistic and may be incorrect, incomplete, or outdated.
2. The AI does not have access to your complete medical history unless you explicitly provide it.
3. The AI may occasionally generate responses that sound confident but are factually wrong — a known limitation of all AI language models.
4. Responses in Hindi, Punjabi, Marathi, and Bengali are auto-generated and may contain linguistic errors.
5. Uploaded reports are analysed for general educational interpretation only — not a substitute for professional pathological or radiological review.
6. Do NOT make clinical decisions based solely on AI responses.

7. Healthcare Provider Listings — Disclaimer

• Provider information is self-reported and is NOT independently verified by MedTalk Central in all cases.
• MedTalk Central does not endorse, recommend, or guarantee any listed healthcare provider.
• Your decision to consult any provider is entirely your own responsibility.
• We are not responsible for the quality, outcome, or safety of any healthcare service you receive.
• Complaints about a provider: contact the Medical Council of India or your state medical council.

8. Intellectual Property

• All Platform content — name, logo, design, AI system, and original content — is the property of ANIDM / MedTalk Central, protected under the Copyright Act 1957.
• You are granted a limited, non-exclusive, revocable licence for personal, non-commercial use only.
• You may not copy, modify, sell, or create derivative works from Platform content without written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law, MedTalk Central, ANIDM, and Amandeep Singh Vaseer shall NOT be liable for:

• Any direct, indirect, incidental, or consequential damages from use of the Platform.
• Any medical outcome or treatment received from a provider found through the Platform.
• Any inaccuracy in AI-generated health information.
• Any data loss, service interruptions, or technical failures.

Our total aggregate liability shall not exceed the amount you paid to MedTalk Central in the 3 months preceding the claim (or ₹1,000, whichever is greater).

10. Governing Law and Disputes

• These Terms are governed by the laws of India.
• Disputes are subject to the exclusive jurisdiction of the courts of Chandigarh, India.
• We encourage you to first contact [email protected] — we aim to resolve disputes within 30 days.
• For consumer complaints, you may approach the National Consumer Disputes Redressal Commission (NCDRC).

11. Changes to These Terms

• We may update these Terms at any time. The revised effective date will always be shown at the top.
• For material changes, registered users will be notified via email at least 14 days in advance.
• Continued use after the effective date constitutes acceptance of the revised Terms.
